These BetterCast User Terms (the “User Terms”) govern your access to and use of the online events platform provided via the website at Bettercast.io (”BetterCast”) by BetterCast co. ltd. Suite 128/20-40 Meagher St Chippendale NSW 2008. (“we“, “us“, or our“).
Please read these User Terms carefully.
You confirm that you have read, understood and agree to be bound by these User Terms by clicking the “accept” button before being granted access to BetterCast, or otherwise where you access or use BetterCast, or you register an account with us. A legally binding contract between you and us will then be formed (the “User Agreement”), consisting of these User Terms, governing your access to and use of Bettercast.
BetterCast is a virtual event-hosting platform for organisations and individuals who want to host online events (“Events”). As set out in paragraph 3.1, we take the security of BetterCast very seriously and have taken a number of measures to ensure that your content and Contributions (as defined below) are protected.
In these terms, we used the definition “Host”. These are the companies, businesses, individuals, and organisations that use BetterCast as a platform to organise and host their events.
There are two different types of BetterCast users to which these terms apply to:
In these terms, unless specified otherwise you are a “User” or “ User”.
Events are organised and administered by the Host, not us. We are a third party providing the platform for an Event to take place. We are not responsible and cannot be held liable:
If any of the matters listed above have caused an issue for you, or you have paid for a ticket to an Event and would like to discuss a refund, you should contact the Host, whose responsibility it is to deal with the matter.
Our only responsibility is to provide the technical facility for the Event to run. If you are experiencing technical issues with BetterCast, please contact us as set out below.
The Host has full control over the running of any Event. This includes control over any Users, when Events are created and how they are configured, and what functionality and third-party integrations are activated for use at each Event.
The Host may prohibit or withdraw access to Events and/or BetterCast to any User at any time.
It is solely the Host’s responsibility to:

You agree that you will:
As part of your participation in an event, you may submit content, information, and data, such as messages or files, to BetterCast (“Contributions”).
We use reasonable security measures in order to protect Contributions against unauthorised copying and distribution. However, we do not guarantee that any unauthorised copying, use or distribution of Contributions by third parties will not take place. To the furthest extent permitted by applicable law, you hereby agree that we shall not be liable for any unauthorised copying, use or distribution of Contributions by third parties (including other Users). The security measures we use to protect your Contributions are provided and used “as-is” and with no warranties, guarantees, conditions, assurances or other terms that such security measures will withstand attempts to evade them.
Subject to these User Terms and the Community Guidelines, you may share political opinions; participate in political activity; provide links to a political committee’s official website, including the contribution page of a political committee; and solicit Participants to make contributions directly to a political committee. You agree, however, that these activities are entirely your own. Moreover, by engaging in these activities, you represent and warrant that you are eligible to engage in them under applicable law and that you will abide by all relevant laws and regulations while doing so.
You will ensure that you comply with any advertising guidelines or applicable laws that may apply to any promotional or marketing activities you carry out on or using BetterCast. For example, if you have been paid or provided with free products in exchange for discussing or promoting a product or service through BetterCast, or if you are an employee of a company and you decide to discuss or promote that company’s products or services on or using BetterCast, you agree to comply with all applicable requirements for disclosing such relationships. You, and not us, are solely responsible for any endorsements or testimonials you make regarding any product or service through Bettercast.
Users may promote, administer, or conduct a promotion on, through, or using BetterCast (a “promotion”). If you choose to promote, administer, or conduct a promotion, you must adhere to the following rules: (a) You may carry out promotions to the extent permitted by applicable law, and you are solely responsible for ensuring that any promotions comply with any and all applicable laws, obligations, and restrictions; (b) You will be classified as the promoter of your promotion in the applicable jurisdiction(s), and you will be solely responsible for all aspects of and expenses related to your promotion, including, without limitation, the execution, administration, and operation of the promotion, the drafting and posting of any official rules, the selection of winners, the issuing of prizes, and obtaining all necessary third-party permissions and approvals. We have the right to remove your promotion from BetterCast if we reasonably believe that it does not comply with these User Terms or applicable law; (c) we are not responsible for and do not endorse or support any such promotion. You will ensure that it is clear that the promotion is yours and that we do not sponsor or co-sponsor the promotion.
With respect to streaming live and pre-recorded audio-visual works, the rights granted by you hereunder terminate once you delete such contributions from BetterCast, or generally by closing your account, except:
(a) to the extent, you shared it with other Users as part of BetterCast and those Users copied or stored portions of the Contributions in question;
(b) we used it for promotional purposes; and
(c) for the reasonable time, it takes to remove it from backups and other systems.
Where you are a participant and any of your contributions include your personal data, we shall be the data controller and will handle your personal data in accordance with our privacy policy.
Where you are an Organiser and any of your Contributions include your personal data, the Host will be the data controller. We will only be the processor, instructed to process such data on the Host’s behalf. If you would like to exercise any of your legal rights in respect of your personal data that may be held by us, you should direct your request to the Host. If you direct your request to us, we will not be able to respond to you directly without first obtaining the permission and instructions of the Host.
You acknowledge that:
Your Contributions will be owned by the Host. Under our contract with the Host, the Host may have certain choices and control over your Contributions, including the right to use, delete or modify the Contributions.
You must:
All intellectual property rights in BetterCast throughout the world belong to us (or our licensors) and the rights in BetterCast are licensed (not sold) to you. You have no intellectual property rights in, or to, BetterCast other than the right to use it in accordance with these User Terms.
If we fail to comply with these User Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these User Terms, both we and you knew it might happen.
This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
BetterCast is for domestic and private use. If you use BetterCast for any commercial, business, or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
BetterCast is provided for general information and entertainment purposes only. It does not offer advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of information obtained from BetterCast. We make no representations, warranties or guarantees, whether express or implied, that such information is accurate, complete or up to date.
Whilst we have taken reasonable security measures to protect your content and data as set out in paragraph 3.1, we recommend that you back up any content and data used in connection with BetterCast.
BetterCast has not been developed to meet your individual requirements. Please check that the facilities and functions of BetterCast meet your requirements.
If our provision of BetterCast or support for it is delayed by an event outside our control then we will contact you as soon as reasonably possible to let you know and we will take steps to minimise the effect of the delay. Provided we have acted reasonably in letting you know about the delay where it is possible for us to do so, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end your contract with us.
BetterCast may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any). You will need to make your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them.
There will also be content created by third parties (such as contributions from other Users) displayed on or communicated by BetterCast. We do not control or endorse any such content or make representation or warranty regarding such content, including regarding its accuracy, completeness or its origin. We do not create such content; nor do we monitor or moderate it, and we are not responsible for doing so.
This agreement will come to an end:
We can terminate this User Agreement and/or your right to access or use BetterCast at any time, without notice, including where we reasonably consider that:
(a) your use of BetterCast violates these User Terms or applicable law;
(b) you fraudulently use or misuse BetterCast; or
(c) we are unable to continue providing BetterCast to you due to technical or legitimate business reasons.
If we end your rights to use BetterCast:
Please be aware that internet transmissions are never completely private or secure and that any message or information you send on or using BetterCast may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
By using BetterCast, you agree to us collecting and using technical information about the devices you use BetterCast on and related software, hardware and peripherals to improve Bettercast.
Certain aspects of BetterCast, will make use of location data sent from your devices. You can turn off this functionality at any time by turning off the location services settings for BetterCast on the device.
In order to use BetterCast, it is necessary that you have a device that allows you access to the Internet, a website browser installed with plugins that allow Flash technology, with “cookies” and JavaScript enabled, and an email. In order for certain functionalities and features to work properly, a camera or microphone and a headset or loudspeaker must be on and not used by another application. You expressly acknowledge and agree that we are not responsible for satisfying the foregoing requirements, and that the quality of messages, information or files sent, posted, streamed, published or otherwise transmitted using BetterCast may differ from the uploaded stream or file, in order to conform and adapt to standards of transferring data, connecting networks, devices or requirements of BetterCast.

If we have to contact you we will do so by email or a notification on BetterCast, using the contact details you have provided to us.
From time to time we may automatically update and change BetterCast to improve performance, enhance functionality, reflect changes to the operating system or address security issues. We will not need your consent to do this and your continued use of BetterCast following the update will be subject to these User Terms
If you stream BetterCast onto any phone, laptop, desktop or other device not owned by you, you must have the owner’s permission to do so. You will be responsible for complying with these User Terms, whether or not you own the phone or other device.
We may need to change these User Terms to reflect changes in law or best practice or to deal with additional features which we introduce. We will do so by sending you a notification when you next use BetterCast where you will be required to accept the updated User Terms.
If you do not accept the notified changes you will not be permitted to continue to use BetterCast.
We may transfer our rights and obligations under these User Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these terms.
You may only transfer your rights or your obligations under these User Terms to another person if we agree in writing.
Each of the paragraphs of these User Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing this agreement, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these User Terms, or if we delay in taking steps against you in respect of your breaking this agreement, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
These terms are governed by Australian law and you can bring legal proceedings in respect of the products in the Australian courts.
We may take proceedings against you in any other court of competent jurisdiction, and the taking of proceedings in any one or more jurisdictions will not preclude us from taking proceedings in any other jurisdiction, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
